dc.description.abstractPenelitian ini membahas mengenai salah satu fenomena pelanggaran Hak Asasi Manusia di Indonesia mengenai kebebasan beragama yang terdapat dalam surat keputusan Pokgiat No. 03/POKGIAT/Krt/Plt/X/2015 di Pedukuhan Karet Bantul, Yogyakarta. Sehingga muncul suatu permasalahan terkait surat keputusan pokgiat yang dapat dikategorikan melanggar HAM. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dengan menggunakan pedakatan perundang-undangan atau statute approach, pendekatan konseptual atau conceptual approach. Adapun hasil penelitian ini pengolahan bahan hukum dilakukan secara studi Pustaka Hasil penelitian menunjukkan bahwa surat keputusan pokgiat Nomor 03/POKGIAT/Krt/PLt/X/2015 pada dasarnya tidak sah untuk diberlakukan, karena surat pokgiat ini memiliki isi yang sangat bertentangan dengan ketentuan yang terdapat pada pasal 22 Undang-Undang Hak Asasi Manusia, yang memiliki kedudukan lebih tinggi. Terlebih Negara Republik Indonesia pada Pasal 28E ayat 1 UUD 1945 telah menjamin hak dasar masyarakatnya untuk dapat bebas beragama / This research discusses one of the phenomena of human rights violations in Indonesia regarding religious freedom which is contained in Pokgiat Decree No. 03 / POKGIAT / Krt / Plt / X / 2015 at Karet Bantul Village, Yogyakarta. So that there arises a problem related to the activist decree which can be categorized as violating human rights. This study uses the juridical normative research type using statutory or statute approach, conceptual approach or conceptual approach. The results of this research are processing of legal materials is carried out by means of a literature study. The results show that the activist decree Number 03 / POKGIAT / Krt / PLt / X / 2015 is basically invalid to be enforced, because this pokgiat letter has contents that are very contrary to the existing provisions. in article 22 of the Human Rights Law, which has a higher position. Moreover, the State of the Republic of Indonesia in Article 28E paragraph 1 of the 1945 Constitution has guaranteed the basic rights of its people to be free of religionen_US
