Abstract
Fenomena LGBT (Lesbian, Gay, Biseksual, Transgender) saat ini telah berkembang di dalam kehidupan sehari-hari. Masyarakat Indonesia dengan kebudayaan timurnya yang menganggap bahwa kaum LGBT merupakan orang-orang yang menyimpang, sehingga kaum LGBT ini masih ragu untuk membuka diri mereka kepada masyarakat. Pengakuan atas hak-hak LGBT adalah resolusi PBB yang pertama yang secara spesifik mengangkat isu pelanggaran HAM berdasarkan orientasi seksual dan identitas gender. Resolusi tentang pengakuan atas hak-hak LGBT inilah yang dijadikan sebagai landasan tuntutan bagi kaum LGBT dalam menuntut hak-hak mereka dengan mengatas namakan hak asasi manusia. Namun demikian, di Indonesia, tentunya berbicara mengenai penegakkan hak asasi manusia, khususnya yang diperjuangkan oleh komunitas LGBT, penegakkannya harus disesuaikan dengan aturan hukum dan nilai-nilai Pancasila sebagai dasar Negara dan landasan falsafah kehidupan berbangsa dan bernegara / The phenomenon of LGBT (Lesbian, Gay, Bisexual, Transgender) has now developed in everyday life. Indonesian society with its eastern culture thinks that LGBT people are deviant people, so that LGBT people are still hesitant to open themselves up to society. Recognition of LGBT rights is the first UN resolution that specifically addresses the issue of human rights violations based on sexual orientation and gender identity. This resolution regarding the recognition of LGBT rights is used as a basis for demands for LGBT people to claim their rights in the name of human rights. However, in Indonesia, of course talking about upholding human rights, especially those fought for by the LGBT community, enforcement must be adjusted to the rule of law and the values of Pancasila as the basis of the State and the foundation of the philosophy of national and state life
