Abstract
Skripsi ini akan membahas mengenai kekuatan hukum Perjanjian Bersama antara PT. Asahimas Flat Glass, Tbk. dengan Serikat Pekerja PT.Asahimas Flat Glass, Tbk. dalam penyelesaian Perselisihan Hubungan Industrial melalui mediasi di Dinas Tenaga Kerja Kabupaten Sidoarjo dan upaya hukum yang dapat ditempuh apabila salah satu pihak yang dirugikan atas tidak dilaksanakannya isi dari Perjanjian Bersama tersebut. Hasil penelitian menunjukkan bahwa kekuatan hukum Perjanjian Bersama dalam Penyelesaian Perselisihan Hubungan Industrial yang tidak didaftarkan ke Pengadilan Hubungan Industrial tetap mempunyai kekuatan hukum selama ada kesepakatan dan yang didaftarkan pada Pengadilan Hubungan Industrial statusnya sama dengan putusan hakim yang berkekuatan hukum tetap dan memiliki kekuatan eksekutorial. Upaya hukum yang dapat ditempuh untuk memberikan perlindungan bagi para pekerja adalah dengan mengajukan eksekusi ke Pengadilan Hubungan Industrial/This thesis will discuss the legal force of the Collective Agreement between PT. Asahimas Flat Glass, Tbk. with the Labor Union PT. Asahimas Flat Glass, Tbk. in the settlement of Industrial Relations Disputes through mediation at the Manpower Office of Sidoarjo Regency and legal remedies that can be taken if one of the aggrieved parties does not implement the contents of the Collective Agreement. The results of the study indicate that the legal force of the Collective Agreement in the Settlement of Industrial Relations Disputes which is not registered with the Industrial Relations Court remains legal as long as there is an agreement and those registered with the Industrial Relations Court have the same status as the judge's decision which has permanent legal force and has executive power. Legal efforts that can be taken to provide protection for workers are by submitting an execution to the Industrial Relations Court
