Abstract
Credit card has function as payment means that is compulsory appears drom economic activities. Cardholder is able to use credit card as good payment mean both in trading transaction and cash. In trading transaction, the cardholder pays on transaction value, by giving the credit card to merchant. Then, merchant will credit the credit card as the transaction value. But in fact, there is merchant who credits the credit card twice without the cardholder`s watch. So that, it gives disadvantages to the cardholder for getting bill from bank as amount twice from the transaction value. This research has purpose to know what the cardholder has responsibility upon the third party error (merchant) on the transaction that give disadvantages to the cardholder. The research method used in this research is normative jurisdiction, that through librarian study and law as norms or dogma. The research result indicates that the cardholder to keep having responsibility upon the disadvantaging transaction including fine and interest for the cardholder had done contract with bank as the credit card issuer proper as the rules in KUHPerdata. But the cardholder must get its refund from the merchant added by restitution such as fine and interest for this is an error from merchant because it does not proper to the compulsory as legality upon KUHPerdata.
