| dc.description.abstract | Trademark is one of the Intellectual Property Rights that protected by the law. The protection of trademark in Indonesia was regulated into Undang – Undang No. 15/2001 tentang Merek. The trademark’s owner will get the law protection of his trademark once he registered it on the Dirjen HKI list. Any kind of violations to this trademark would cause responsibility from the offender. Practically, there are numbers of fabrication and violation toward registered trademarks. For example, the fabrication of football fans clothes with football clubs logo printed/sutured on them, being sold with cheaper price. This case could be categorized as a violation to trademark if the producers or sellers do not have written permission from the football logo’s owner. This research is aimed to get fully understanding about the effectiveness of law protection from Undang – Undang No. 15/2001 tentang Merek to registered trademarks in Indonesia, and to understand the legal consequences to offenders. The research method is Juridis Normative, as efforts to find solutions for the legal issue through researching and analyzing the positive law. The research’s result shows that the usage of football clubs logo into football fans clothes is a violation to Undang – Undang No. 15/2001 tentang Merek. It is because the football clubs logo is categorized as famous-trademark that should be protected by Indonesian law based on Pasal 6 ayat (1) huruf b Undang – Undang No. 15/2001 tentang Merek. The offender could be responsible in public law, private law, and administrative law based on Pasal 76, Pasal 78, Pasal 90, dan Pasal 91 Undang – Undang No. 15/2001 tentang Merek. | en_US |
