dc.description.abstractThe development of the contract law is marked with the establishment of the standard contract which is used by the people in the business transactions. The standard contract, whose establishment only involves one party, give the chance to the party established that contract to put on clauses that limit or even dismiss responsibility. BW as the positive law that adjust the contract, acknowledge the principle of consensus, like has been ruled in the Article 1338 BW that is related closely with the requirements of deal in Article 1320 BW. The aim of the principle of consensus is to make the contract arranged on the free-dealing within the parties. Therefore, this thesis made to find the realization of the principle of consensus in the standard contract that contains the clause of exoneration, including the juridical consequences that followed. This thesis is using the research method of normative juridical, using the conceptual approach and the statute approach. The law materials that are used, including the primer law materials and secondary law materials. The results of the research show that normative contract contains the clause of exoneration, violate the requirements of deal and also contains misuse of circumstances, so that could be cancelled by asking nullification to the court.en_US
