PELEPASAN TANAH KAS DESA (TKD) DAN PERMASALAHANNYA (Analisis Pelepasan TKD untuk Real Estate)
Abstract
This study aims to identify and analyze the authorities to give approval
related to the release of land the village treasury. And also to find out and analyze
how the acquisition of land by housing companies from the land village treasury
and ruilslag land village treasury. This research is normative by means of
literature. The approach used is the Statute Approach and Conceptual Approach.
This thesis focuses on the release of land village treasury and its problem (analysis
of the release of land village treasury to real estate)
The results in the release is that land of village treaasury is common
problem because people think the lack of socialization. Village Chief need to give
a decision and BPD approve the release of land village treasury. During its size to
be clear, the amount of compensation in land, at least equivalent to the liberated
lands village treasury. Replacement land should be located within one block of
land in one stretch of the village treasury.
The Minister of domestic should not restrict the release of the village
treasury land only for public interest, because the release of land village treasury
real estate not only ruilslag, but also to compensate. In this case the Minister of
domestic does not need to impose limits, it would be detrimental to real estate,
due to the length of the process involves the release of land village treasury and
the not less labor or costs are charged.
