Abstract
The concept of franchising is a great alternative in order to reduce the risk
of loss due to corporate policy of the country's political, security stability, high
transport costs, customs or culture, and the rule of law is difficult due to the
investment pattern of changing people's lives, because each change is not
necessarily advantageous to produce something so often happens with anxiety in
the community to protect themselves from unwanted effect will these changes.
The problem formulation in this study is to discuss legal and legal
consequences for the franchisee and franchisor to realize their desires in its
berfranchising obstacles that arise in the process of trademark registration and
how to overcome them.
The study was a normative juridical studies, the data required in the form of
secondary data or literature data in the form of legal materials. The Legal
Protection of the Franchisor (the franchisor) and the Franchisee Parties
(franchisee) will be better protected if the Franchise Agreement portend certain
restrictions that must be complied with by the franchisee and franchisor.
