KAJIAN VIKTIMOLOGIS TERHADAP PELAKSANAAN REHABILITASI (STUDI KASUS PUTUSAN PK MARI No. 47 PK/PID.SUS/2012)

Abstract

MM is a House of Representative member period 2009-2014, known as the initiator of The Special Committee of the Century Bank on the right of inquiry, and often proposes to solve the case of the Century Bank as soon as possible. MM activity generate political elite’s allergy, and the result is, in 27 April 2010 MM was detained by the Police Detective Institution (Bareskrim) of the Indonesian Police (Polri) for conjecture of making false documents related to the letter of credit of Century Bank, collaborating with Frangky Ongkowardojo. Supreme Court decision state that MM was guilty because of making false documents related to the letter of credit of Century Bank. The result of the Supreme Court decision about the guilty of MM was to withdraw MM from the position as the member of the House of Representative by changing over time (PAW). MM did not feel satisfied and ask for reconsideration to the Supreme Court. The Supreme Court received the demand from MM, and in the decision of reconsideration was the Supreme Court states that MM was not guilty of making false documents related to the letter of credit of Century Bank, and gives MM rehabilitation. In fact, MM could not be rehabilitated, because there is no law to bring MM back as a member of The House of Representative. There is a legal vacuum in the application of the rehabilitation that make MM as a victim.
